Can Tesla Stop Signature Plaid Resellers?

The infamous "no resale" policy has returned once again

The Model S and Model X built the modern electric vehicle industry. Tesla launched the Model S in 2012 at a time when the mainstream automotive world considered EVs a novelty, and the car’s performance and range proved everyone wrong. Now, after 14 years in production, both models are done. Tesla has set aside 250 units of each as a farewell, and a small number of loyal customers, employees, and influencers are getting the chance to buy them. The cars are extraordinary. The contract attached to them is something worth reading very carefully before signing.

Who is Getting Tesla Signature Plaid Invites?

Tesla is sending purchase invitations by email to a select group that appears to include long-tenured employees, Tesla content creators, and owners with a history of loyalty to the brand. There is no public application process and no official waitlist.

That said, Tesla is watching its customer base closely, and a few things may improve your odds if invitations go out in waves. Owning multiple Teslas or having a long ownership history with the brand is probably the strongest signal. Staying active in the Tesla community and having a substantial audience on social media also appears to matter; early invitees include prominent Tesla influencers on Xitter.

If you do receive an invite, the Model S Signature and Model X Signature ordering pages are reportedly live and invite-gated. Each car comes in at $159,420 and includes exclusive Garnet Red paint, luxury interiors and wheels, gold carbon ceramic brakes, four years of premium service, Full Self-Driving (Supervised), and free lifetime Supercharging.

The Model S specs out at 309 miles of range, 0-60 in 1.99 seconds, and a 200 mph top speed. The Model X comes in at 303 miles of range, 0-60 in 2.5 seconds, and 163 mph. Performance is unchanged from the standard Plaid trims; everything exclusive is cosmetic and experiential.

One important note: the Luxe Package perks — Premium Connectivity, FSD, and free Supercharging — do not transfer to a new owner on resale. That has real implications for secondary market value, which we’ll get to.

Is Tesla's No Resale Policy Enforceable?

Every buyer of a Signature Edition is required to sign a no-resale agreement. The contract language is specific: you agree not to sell the vehicle within the first year of ownership. If you must sell for an unforeseen reason, Tesla gets right of first refusal at the purchase price minus $0.25 per mile and reconditioning costs.

If Tesla declines to buy it back and you want to sell to a third party, you need written consent from Tesla. Violating the agreement exposes you to “liquidated damages” of $50,000 or the consideration received for the sale, whichever is greater.

That sounds serious. But there is a substantial body of legal opinion suggesting Tesla would have a very difficult time enforcing this in court.

The underlying legal doctrine is called restraint on alienation. As Cornell Law School’s Legal Information Institute explains, courts have long disfavored restrictions on the transfer of property, on the grounds that owners should be free to dispose of what they own. Restrictions are only upheld when they are reasonable in scope and purpose. A blanket prohibition on resale for a year, backed by a $50,000 penalty on a consumer goods transaction, is a significant ask from a court.

The California Lawyers Association has written on this topic directly in the context of California Civil Code Section 711, which voids restraints on alienation that are “repugnant to the interest created.” While that statute is typically applied to real property, courts have applied similar reasoning to personal property. Harvard Law professor Joseph Singer, who tracks restraint on alienation case law, documented a 2024 California Court of Appeal decision voiding a clause that limited both the pool of buyers and the price a seller could receive — precisely what Tesla’s agreement does.

Attorneys who participated in public discussions of the Cybertruck’s identical clause were largely skeptical of its enforceability, with one litigator noting they “wouldn’t be surprised if a Court didn’t enforce it” on similar grounds to how non-compete clauses get thrown out in California.

And then there’s the Cybertruck precedent itself. Tesla attached the same $50,000 no-resale clause to early Cybertruck Foundation Series purchases in late 2023. Electrek confirmed that Tesla never sued anyone over resale violations, blacklisted a small number of buyers from future purchases, and quietly removed the clause entirely from Cybertruck contracts by November 2023. The Washington Times reported the removal came without any official statement from Tesla. AutoEvolution noted the clause was “mostly ignored by everyone, including Tesla.”

Our read: Tesla’s no-resale clause is almost certainly not worth the paper it’s printed on from a litigation standpoint. As far as we can tell, the company has never sued a single Cybertruck reseller despite the identical policy, and multiple legal commentators have questioned whether the clause would survive a challenge in court. The practical risk of actually being sued is low. You will definitely be blacklisted from buying any future Tesla vehicles though.

That said — and this is the critical part — we are not lawyers, this is not legal advice, and you should absolutely discuss this contract with an attorney before signing if you intend to resell for a profit. Tesla could choose to pursue aggressive enforcement on this edition specifically given the smaller batch size. And even a lawsuit that Tesla would likely lose costs you time, legal fees, and stress. Go in with eyes open.

What are Tesla Signature Plaid Cars Worth?

With only 250 units of each model, these are among the smallest production runs Tesla has ever done on a passenger vehicle. The Model S and Model X are genuinely historically significant cars — the vehicles that proved the modern EV market was possible. Final production examples of iconic vehicles have a track record of commanding serious premiums.

The Cybertruck Cyberbeast Foundation Series, a vehicle produced in far greater numbers (at least 30,000 Foundation Series were built), sold at dealer auction in early 2024 for over $240,000 — more than double its roughly $120,000 MSRP. Even standard AWD Foundation Series Cybertrucks were fetching $100,000 or more over sticker in the immediate post-launch window.

The Signature Plaid editions are launching at $159,420 with 250 units of each. By comparison, the Cybertruck had 25,000 Foundation units and still hit $100,000+ premiums at peak hype. That supply scarcity matters enormously to collectors and speculators. A $50,000 premium over sticker on a vehicle this scarce feels like a conservative estimate if demand tracks the way Cybertruck hype did in early 2024.

There are caveats worth naming. The non-transferable Luxe Package reduces utility for secondary buyers, since the new owner loses FSD and free Supercharging on transfer. That will shave some value off relative to what the first-owner bundle represents. The broader Tesla brand has also had a rough couple of years commercially, and whether these cars attract the same fervor as the Cybertruck at its peak is an open question.

Still, 250 units of the final Model S and 250 units of the final Model X is a genuine scarcity story. If you are lucky enough to receive an invite and are prepared to navigate the contract’s legal gray area, the upside here is real.
