Kevin Durant Prime Bottles Resell After Lawsuit

Two weeks ago, the U.S. Olympic Committee filed suit against Logan Paul and KSI’s Prime Hydration brand for copyright infringement. Certain bottles and online ads contained phrases Prime was not authorized to use. The result? Quick backpedaling, and the infringing drinks being pulled from the market. This lawsuit is a long way from being settled, but it seems like the Kevin Durant Prime drinks named in the suit will be permanently discontinued, and resellers are jumping on the opportunity.

If you’re not familiar, Prime is the brainchild of YouTubers Logan Paul and KSI. While ostensibly aimed at athletes in need of quick electrolyte replenishment, Prime is most popular with the mostly-teenage fans of the YouTubers involved.

We’ve written about a lot of different Prime releases too, from Dodger Stadium-exclusive Ice Pop bottles to a global promotion that ran earlier this year. All you really need to know is that people (kids) love Prime, and love to spend their (parents’) money on it.

So pay attention when we say there’s a new flavor out there that’s reselling. Ahead of the 2024 Summer Olympics, Prime spun up a new line of flavors and bottle designs that name drop big athletes, among them Kevin Durant.

And in the branding and promotion for this drink, Prime celebrates Durant’s three Olympic wins, uses the words “Olympian” and “Team USA”, along with the phrase “Going for gold”. Additionally, it seems like Prime also supplied infringing ad copy to retailers.

This is a no-no. The U.S. Olympic Committee has an exclusive copyright over these words, and they generate a large portion of their revenue (and Team USA’s funding) by leasing the rights to companies ahead of the game’s. This year Coca-Cola is the exclusive user of Olympic copyrights for beverages.

The Olympic Committee will fight hard to protect these copyrights and the inherent value derived from their exclusive use. They gave Prime a cease-and-desist on July 10 over the KD bottles, and filed a lawsuit on July 26 after being ignored.

You can read their complaint here. The US Olympic Committee is seeking all revenues from the Kevin Durant Prime bottles and a total shutdown to production and recall for all bottles. They will also seek additional damages at trial in the “millions of dollars” range.

How will Logan Paul and KSI get out of this one? We have an idea.

Prime Kevin Durant Drinks Resell

There are a couple important things to take away from this whole situation. The most important is that while we don’t know what will happen, production on these bottles is likely permanently halted.

If the USOC actually gets the revenue for the KD Prime drinks and gets them recalled, that’s a massive headache for Prime that gets worse with every bottle sold. Prime has already begun scrubbing their socials for posts identified in the lawsuit, so they’re clearly being proactive.

And while Prime may have pulled the listing from their website, individual vendors haven’t. Yes, you can still buy Kevin Durant Prime drinks online.

Amidst all this turbulence, resellers are quietly stocking up on these soon-to-be-discontinued drinks, and even starting to flip them. Right now, Kevin Durant Prime drinks are reselling for about $10 a bottle.

That GNC link is selling 12-packs for $30, meaning the potential profit is around $90 per pack. That’s only if you manage to flip all twelve for $10, and people stay interested, and Prime doesn’t get on these vendors’ asses and make them cancel your order.

That’s a lot of ifs, but we’re also just talking about $30 here. If you buy it and it bricks, either try to get a refund from the vendor or knuckle down and just drink the bottles. Up to you.
